Answer: Since drivers are not employed by Uber, they are to use their own discretion when it comes to matters such as this. Uber does, however, ask drivers to follow the law when it comes to using their phone or Bluetooth while driving. Even if the call is from or to another Uber rider; it’s suggested that the driver be mindful and avoid using their device.

If you are in an Uber and you feel your driver is distracted in any way and you feel unsafe, you should politely ask the driver to let you out at the nearest safest location.

If the issue is not that serious, but instead just rude and unprofessional, you should leave your driver the appropriate star rating with feedback. If you leave detailed feedback of the issue Uber will normally follow up with the driver.

Conclusion: Since drivers are just independent contractors and not employed by Uber. Uber do not have a set policy in place regards to the use of their cellphone while driving on the rideshare platform.
